1. Acceptance of Terms

By accessing or using shop.talkyco.com (the "Shop"), placing an order, or creating an account, you ("Customer" or "you") agree to be bound by these Terms & Conditions ("Terms"). These Terms constitute a legally binding agreement between you and TalkyCo LLC ("TalkyCo," "we," "us," or "our").

If you do not agree to these Terms, do not use the Shop or place orders.

2. The Service

TalkyCo Shop is an online retail store operated by TalkyCo LLC. The Shop offers over-the-counter (OTC) healthcare products for sale to eligible customers located in the United States. TalkyCo is not a pharmacy, healthcare provider, or medical facility.

3. Eligibility

To purchase from TalkyCo Shop, you must:

• Be at least 18 years of age (or the age of majority in your jurisdiction)
• Reside in an eligible U.S. shipping location
• Have a valid payment method
• Not be prohibited by law from receiving OTC healthcare products

Some products may have additional age restrictions per applicable law. By purchasing age-restricted products, you confirm you meet those requirements.

4. Account Registration

You may purchase as a guest or create an account. If you create an account, you are responsible for maintaining the confidentiality of your login credentials and all activity under your account. Notify us immediately at support@talkyco.com of any unauthorized account use.

5. Product Descriptions & Availability

We strive to provide accurate product descriptions, images, and pricing. However, errors may occur. We reserve the right to correct any errors and to cancel orders placed based on inaccurate information.

Product availability is subject to change. We reserve the right to limit quantities and to discontinue products at any time. All products are sold as described on their individual product pages.

6. Orders, Payment & Pricing

All prices are in U.S. dollars. Prices may change without notice. The price charged is the price displayed at the time your order is confirmed.

We accept major credit and debit cards. Payment is due at the time of order. Your order is confirmed when you receive an email confirmation from us. We reserve the right to cancel orders for any reason, including pricing errors or suspected fraudulent activity, with a full refund issued to the original payment method.

7. Shipping

We ship to eligible U.S. addresses. Shipping rates, estimated delivery times, and policies are described in our Shipping Policy, which is incorporated into these Terms by reference.

8. Returns & Refunds

Return and refund policies are described in our Returns & Refund Policy, which is incorporated into these Terms by reference. In summary: unopened products may be returned within 30 days; opened OTC products generally cannot be returned for safety reasons.

9. Promotions & Coupons

Promotional offers, discount codes, and coupons are subject to their stated terms and expiration dates. Promotions are subject to availability and may be modified or discontinued at any time. Coupon codes cannot be combined unless explicitly stated.

10. Taxes

We may be required to collect applicable sales tax on orders shipped to certain states. Sales tax, if applicable, will be calculated and displayed at checkout. You are responsible for any applicable local taxes not collected by TalkyCo.

11. SMS Marketing

Program Description

The TalkyCo SMS Marketing Program provides recurring marketing text messages about eligible OTC products, promotions, discounts, special offers, new products, and product availability.

The TalkyCo SMS Marketing Program is intended for marketing communications concerning eligible OTC products and related promotional offers. SMS messages do not provide medical advice, diagnosis, or treatment recommendations. TalkyCo does not send prescription information, prescription updates, prescription refills, prescription availability notices, telehealth SMS, or medical reminders via this program.

Consent & Opt-In

By voluntarily checking the SMS marketing consent checkbox and submitting your mobile number, you agree to receive recurring marketing text messages from TalkyCo regarding eligible OTC products, promotions, discounts, special offers, new products, and product availability.

End users opt in by visiting https://shop.talkyco.com and entering their mobile phone number in the SMS subscription form. Users must actively select an unchecked SMS consent checkbox — it is never pre-selected.

The consent disclosure displayed at opt-in states:

• That messages are recurring and marketing in nature
• The message frequency (which may vary)
• That message and data rates may apply
• How to reply STOP to unsubscribe
• How to reply HELP for assistance
• That consent is not required to make a purchase
• Links to SMS Terms and Privacy Policy

The SMS consent checkbox is unchecked by default. No marketing SMS messages are sent to users who have not affirmatively opted in.

Message Frequency

Message frequency may vary.

Messages may include:

• New OTC product announcements
• Special offers and promotional discounts on eligible OTC products

Costs

Message and data rates may apply. Text message rates and data charges depend on your mobile carrier plan and device. TalkyCo does not charge a fee to participate in the SMS program. Please check with your mobile carrier if you have questions about applicable charges.

How to Stop (Opt Out)

To stop receiving marketing messages, reply STOP to any TalkyCo marketing text message. After you send STOP, you will receive a confirmation message and will no longer receive TalkyCo marketing messages unless you subsequently provide new consent.

You may also unsubscribe from TalkyCo marketing text messages at any time by replying STOP to any TalkyCo marketing text message.

Upon receiving your STOP reply, you will receive one final text message confirming your unsubscription:

After unsubscribing, you will receive no further marketing text messages from TalkyCo. You may re-subscribe at any time by visiting shop.talkyco.com and completing the opt-in form.

Consent Is Not a Condition of Purchase

Supported Carriers

Supported carriers may include all major U.S. mobile carriers including AT&T, Verizon, T-Mobile, Sprint, and other regional carriers. Carrier participation may vary. The program may not be available on all carriers.

Privacy

TalkyCo does not sell or rent mobile phone numbers or SMS opt-in information for third-party marketing purposes. Mobile information and SMS consent records will not be shared with third parties or affiliates for their own marketing or promotional purposes. Mobile information may be shared with service providers solely as necessary to provide SMS delivery, customer support, order fulfillment, payment processing, security, and other operational services. Such service providers are not permitted to use mobile information for their own marketing purposes.

13. Intellectual Property

All content on the Shop, including text, images, logos, graphics, and software, is the property of TalkyCo LLC or its licensors and is protected by applicable intellectual property laws. You may not reproduce, copy, distribute, or use any content without prior written permission from TalkyCo.

14. Limitation of Liability

To the fullest extent permitted by law, TalkyCo LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Shop or purchase of products. Our total liability for any claim shall not exceed the amount paid for the specific product giving rise to the claim.

15. Governing Law

These Terms are governed by the laws of the United States and the state in which TalkyCo LLC is incorporated, without regard to conflict of law principles. Any dispute arising from these Terms or your use of the Shop shall be resolved through binding arbitration or in courts of competent jurisdiction.

16. Changes to These Terms

We may update these Terms at any time. Updated Terms will be posted at this URL with a new "Last Updated" date. Continued use of the Shop after changes are posted constitutes acceptance of the updated Terms.
